1. Who we are and what these terms are
Saudad (https://saudad.ai) is provided by ANDGINJA DIGITAL SERVICES, LDA, Av. Avelino Teixeira da Mota, Lote 308, 5º Esq., 1950-034 Lisboa, Portugal, VAT/NIPC PT517700263 (“we”, “us”). Contact: andre@andginja.com.
These terms are the agreement between you and us when you use Saudad. Our privacy policy explains how we handle personal data. By signing in to create your account you accept these terms; the sign-in page says so.
If you use Saudad as a consumer, nothing in these terms takes away the rights consumer law gives you.
2. The service
Saudad is hosted memory for AI agents. You sign in with a code we email you, connect your agents, and they can save and read memories and notes, organised into spaces (up to 20). Every agent you connect shares the same memory. In your dashboard you can see, search, edit, forget and undo (for 7 days), export everything, and delete your account.
Saudad has no AI of its own: your agent decides what to save and what to look up. Saudad never sees your conversations, only what your agent sends to save and the searches it makes.
Daily limits apply to protect the service: today, 2,000 saves and 20 MB of saved text a day per memory. We describe current limits on the pricing page.
3. Your account
- One account per person, tied to your email address. Keep access to that inbox safe: anyone who can read it can sign in as you.
- You must be at least 18 years old.
- Give a real email address that you control.
- API keys you create are like passwords: keep them secret, and revoke any key that may have leaked.
- You are responsible for what happens under your account, including what the apps you connect do with it.
4. Invite-only beta and free use
Saudad is currently invite-only. Only invited email addresses can create an account. An account created from an invitation is complimentary (“Saudad Personal, complimentary”): you pay nothing, and it stays complimentary when paid plans open, unless we tell you otherwise with at least 30 days’ notice. When that happens you get a free 14-day trial before anything is charged, and you can export or delete everything at any time.
During the beta Saudad may change, and some features may be added, changed or removed. We will tell you in advance before a change that takes away something you rely on.
5. Paid plans (when they open)
Paid plans are not on sale yet. When they open:
- Saudad Personal costs €12 a month, or €108 a year. Prices include VAT; the total shown at checkout is what you pay. In US dollars the numbers are the same.
- Free trial. While sign-up is open, new accounts get 14 days free, without a card. If you choose a plan during the trial, you keep the days left and the first charge is when the trial ends (in the trial’s last two days, the charge is taken at once).
- Founding members. The first 100 subscribers keep their price for as long as they stay subscribed.
- Payment is taken by Stripe. Plans renew automatically at the end of each month or year until you cancel.
- Price changes. We will tell you at least 30 days before a new price applies to you, and you can cancel before it does.
- Invoices are issued by us under Portuguese law.
Cancelling
Cancel any time from Settings, in Manage billing. A cancelled plan runs to the end of the period you paid for and then stops; you are not charged again. You can also switch between monthly and yearly there.
Refunds and your right to withdraw
- Your first payment, monthly or yearly: a full refund if you ask within 14 days of paying it.
- Any yearly payment, including a renewal: a full refund if you ask within 14 days of paying for the year.
- If you are a consumer, this covers your legal right to withdraw from a contract made at a distance within 14 days: you get all of your first payment back, not only a part of it.
- To ask for a refund or withdraw, write to andre@andginja.com from your account’s email address. A clear sentence is enough; you don’t have to give a reason.
- A refund does not by itself cancel your plan; tell us if you also want it cancelled.
When a trial or plan ends
If your trial or plan ends without a new payment, your agents pause: they can no longer read or save. Your dashboard keeps working, so you can still see and export everything. We keep your memory for 30 days after the pause and email you twice before we delete it. After that, choosing a plan starts a new, empty memory, and your apps need to be connected again. Your account itself stays until you delete it.
Deleting your account cancels your subscription at once, with no automatic refund for the time left. Within the 14 days above you can still ask for your refund.
6. Your content
It’s yours. Everything your agents save to Saudad, and anything you write or edit in your dashboard, belongs to you (or to whoever it belonged to before).
What you let us do with it. You give us a non-exclusive, worldwide, royalty-free permission to store, copy (including in backups), index for search, send to the agents you connect, show to you, and export your content, only to provide Saudad to you, and only for as long as we hold it. We don’t sell your content, use it for advertising, or use it to train AI models. To make search by meaning work, your text is processed by OpenAI’s embeddings service, as our privacy policy explains.
Your responsibility. You confirm you have the right to store what you and your agents save, including any personal data about other people (for example your clients).
Using Saudad for work. If you use Saudad for your work and store personal data about other people on behalf of your business or your clients, you are the controller of that data and we process it for you. Our data processing agreement then applies to that data and forms part of these terms, without anything to sign.
Accuracy. Your agents decide what to save. Saudad stores it as given; we don’t check whether it is true.
7. Acceptable use
Don’t use Saudad to:
- store or share anything illegal, or anything that infringes someone else’s rights;
- harass, track or harm anyone, or store data about people you have no right to keep;
- upload malware, or attack, probe or test the security of Saudad or other users without our written permission;
- get around limits, access controls or the wall between accounts, or reach anyone else’s data;
- overload the service, for example with automated traffic far beyond normal agent use;
- create accounts in bulk, or share, sell or resell access without our agreement;
- copy or reverse engineer the service to build a competing one, except where the law allows it.
8. Agents and other apps
- You choose which apps connect. Each connection needs your approval on our consent screen, where you choose what it may do: read and save, or read only. Every connected app can use every space in your memory.
- Their terms apply to them. Claude, ChatGPT, Claude Code, Codex, Cursor, OpenClaw and other apps are provided by other companies under their own terms and privacy policies. What an app does with a memory it reads is between you and that app’s provider. We are not responsible for those apps, their availability, or what they save.
- Saudad doesn’t push your memories to any app. An app reads and saves only through the connection you approved.
- Disconnect at any time in your dashboard; the app loses access on its next request.
- Which apps work, and how, can change when those apps change. The connect page says what we have tested.
9. Availability and changes
We work to keep Saudad available and your memory safe, with nightly encrypted backups. But Saudad is in beta, runs on infrastructure we depend on, and may be interrupted for maintenance, updates or failures. We don’t promise any particular uptime.
Keep your own export if losing access to your memory would harm you.
If you are a consumer, you keep your legal rights if Saudad does not conform to what we promised (Decreto-Lei n.º 84/2021, on digital content and services).
10. Suspension and ending
You can stop at any time: disconnect your apps, cancel your plan, or delete your account in Settings. Deletion is immediate and permanent; our privacy policy says what happens to backups and billing records.
We may suspend or close an account, or a connection, if:
- you seriously or repeatedly break these terms, or the law;
- it is needed to protect Saudad, other people or their data (for example a leaked key or an app behaving abusively);
- the law or an authority requires it.
Where we can, we will tell you first, explain why and give you time to export your data. We may also stop offering Saudad altogether; we will give you at least 60 days’ notice and refund any period you paid for and can no longer use.
11. Our liability
- Nothing in these terms limits or excludes liability that the law does not allow us to limit or exclude, including for intent or gross negligence, for death or personal injury, or under consumer protection law.
- If you are a consumer, we are responsible for foreseeable loss caused by our breach of these terms or our lack of reasonable care. We are not responsible for loss that was not foreseeable, or for loss caused by the apps you connect.
- If you use Saudad for business, and apart from the cases in the first point: we are not liable for lost profits, lost revenue, lost business or indirect loss, and our total liability in any 12 months is limited to what you paid us in those 12 months.
12. Changes to these terms
We may update these terms. If a change matters, we will email you at least 30 days before it applies. If you don’t agree, you can stop using Saudad and, for a paid plan, cancel it; we will refund any period you paid for and can no longer use. Small corrections that don’t affect your rights apply when published.
13. Law and disputes
These terms are governed by Portuguese law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. Otherwise the courts of Lisbon have jurisdiction.
Please write to us first: most problems can be solved by email. If we cannot settle a complaint, a consumer in Portugal can also turn to a consumer arbitration centre.
